Securing a Dependent or Disabled Child in the Family Foundation

A family foundation may be one of the most effective legal instruments to secure the life and financial future of a dependent child, especially for the time when their parents are no longer around.

Instead of transferring assets directly to a child with a disability (which carries risks of loss due to lack of decision-making capacity, exploitation, or third-party actions), the founder transfers them to the foundation. The statute can explicitly stipulate that the foundation is obligated to directly pay for medical treatment, rehabilitation, permanent care, adapted housing, or daily living expenses, remitting funds directly to care or medical institutions.

These assets are managed by a professional management board in accordance with the founder’s guidelines, ensuring a steady cash flow for the child’s needs while shielding them from managing complex assets and preventing unauthorized individuals from seizing the funds.
